  • Competition Law in the ASEAN Economic Community Conference: Is Harmonisation Achievable

    At the 54th ASEAN Economic Ministers Meeting in September 2022, negotiations between ASEAN Member States (AMSs) commenced to develop a formal cooperation agreement that would facilitate cross-border cooperation and coordination on Competition Law and Policy matters between these jurisdictions. This was done pursuant to the strategic goals of the ASEAN Economic Community (AEC) Blueprint and ASEAN Competition Action Plan (ACAP) 2025.

    The proposed ASEAN Framework Agreement on Competition (AFAC) aims to facilitate cross-border cooperation between competition agencies, promote the internalisation of competition policy in regional and domestic economic policies and provide effective measures to deal with competition issues of mutual interest. Cooperation and coordination between the national competition authorities of the AMSs must be underpinned by a common set of foundational substantive principles in their respective national competition law frameworks. This conference aims to explore the opportunities and challenges facing the AEC in achieving substantive convergence or harmonisation between the competition laws of the ten AMSs.

    Competition law academic experts from Indonesia, Malaysia, Philippines, Singapore, Thailand and Vietnam will make presentation on the prospects for achieving pro-harmonisation reforms to their respective national competition law frameworks, focusing in particular on two of the most obvious areas for legal convergence: anti-cartel laws and merger control.
